The Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020

The Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020 became LAW on the 1st June 2020.

It will be mandatory to have an electrical inspection carried out at least, every five years for properties in the private rented sector. Failing to comply could lead to penalties of up to £30,000.

A current valid test certificate dated within the last five years, must now be in force for all existing tenancies and any new tenancies.

The inspection should be PRIOR to any new tenancy and ALL tenants must also be provided with a copy of the EICR certification. It is also worth noting that should any C1/C2 recommendation be made, these would have to be completed within 28 days in order to comply!

Who can carry out inspection and testing?

“It’s important that the person carrying out the inspection and testing is competent to do so. The term ’qualified person’ is used throughout the new regulations to define a person who is competent to undertake the inspection and testing and any subsequent remedial works.

Carrying out an inspection of electrical installations is a complex task that requires an extra level of qualification and competency, beyond the standard four-year vocational route commonly followed by qualified inspectors and testers. The government, in conjunction with industry experts, will develop new guidance for landlords stipulating who can carry out the mandatory electrical installation checks.”

NICEIC Competent to provide Electrical Safety Inspections scheme.

The NICEIC has been carrying out separate competency checks to confirm the contractor has the appropriate competency levels to meet the current guidance, this also confirms the contractor holds the required liability insurance AND additional professional indemnity insurance to cover the inspections it carries out. This new scheme is in addition to NICEIC membership as extra levels of competency and insurance are required.
